Cwm Connell Coastal Cottages – Terms & Conditions

When you make a booking using our online reservation system you will receive an automatically generated booking summary, by email, to the email address you provided in the booking form. This does not form a contract between us. A contract shall only arise when we here at Cwm Connell Coastal Cottages personally confirm your booking by either email.

A 30% deposit is required to secure your booking with the balance payment then due 8 weeks prior to the start date of your holiday. If you are booking within 8 weeks prior to the start date of your holiday then a full payment is required. No cottage can be reserved for any length of time without a deposit payment.

CONTRACT. The contract for a short-term holiday rental will be between Cwm Connell Coastal Cottage owners (referred to as, us or we) and the person making the booking and all members of the holiday party (referred to as, you or your) in the following booking conditions. UK law will govern the contract. The contract of hire is not effective until we have received the deposit. The contract will be subject to these terms & conditions and must be complied with. The party leader must be 18 years of age at the time of booking and the booking form must list names and ages of your party. The named booker is responsible for all payments & must ensure that accompanying guests receive a copy and abide by our  Terms & Conditions.

PAYMENT. Bookings are confirmed on receipt of the deposit of 30% of the holiday cost, cottages will not be reserved for any length of time without a deposit payment. The balance of the rental will be due for payment 8 weeks prior to the holiday commencement date and we reserve the right to cancel a holiday where payment has not been received 8 weeks before the commencement date. If the booking is made within 8 weeks of the holiday start date then the full rental payment will be required. Once you have paid the deposit you are responsible for the full rental cost even if you subsequently cancel.

CANCELLATION. All cancellations must be immediately notified to us by email. We will respond to your email within 24 hours. If you don’t receive a response within that time then please contact us by phone 01239 881691.

If you cancel 61 or more days before check-in date, and we are able to re-let your dates, we will refund you the deposit amount, less our £50 admin fee. We will also retain any discount amounts we needed to make to re-let the property. If we are unable to re-let then you remain responsible for the deposit and there will be no refund under any circumstances. Any reimbursements will be made after your check-in date.

Bookings placed after 3rd April 2020 for arrivals after 1st June 2020 have flexible cancellation terms cover. This means that if you cancel between 60 days and 2 days before check-in date, you will receive a full refund of the costs you have paid. You will be reimbursed on check-in date of original booking. If you cancel one day before your check-in date or on the day of check-in, you will not be reimbursed for your booking costs under any circumstances.

Bookings placed before 3rd April 2020 have NO flexible cancellation terms attached. This means that if you cancel anytime before check-in date, and we are able to re-let your dates, we will refund you the deposit amount, less our £50 admin fee and any discount amounts we needed to make to re-let the property. If we are unable to re-let, you remain responsible for the deposit and there will be no refund under any circumstances. You will be reimbursed on your check-in date of original or replacement booking, whichever has the later arrival date. From 42 days before check-in and to the day of check-in, you remain responsible for the full rent and there will be no refund unless we are able to re-let your dates. In which case we will refund you all or part of the sum you have paid, depending on the value of the replacement booking and less our admin fee of £50. You will be reimbursed at check-in date of the original or replacement booking, whichever has the later arrival date.

We reserve the right to treat date/cottage changes made 48 hrs after receipt of deposit as a cancellation and a new booking.

CANCELLATION INSURANCE. Cancellation Insurance is not compulsory but we strongly recommend you purchase insurance to protect against cancellation.

CIRCUMSTANCES BEYOND OUR CONTROL (Force Majeure): If for any reason we have to cancel your booking in advance due to circumstances beyond our control; for example fire, flood, exceptional weather conditions, epidemics, destruction/damage to the property you will be offered an alternative date. If a new date cannot be agreed upon by you or ourselves then you will be offered a credit note to the full amount of the booking, valid from 12 months of your arrival date. If we have to terminate your holiday early for the above reasons you will be offered a credit note to part of the booking fee based on the time remaining of the booking, valid from 12 months of your arrival date. No additional compensation, expenses or costs will be payable.

PERIOD OF HIRE. You should arrive after 4pm on the commencement date, check out is at 10am at the latest on the departure date. Check out later than 10am will be charged a further days rental.

You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties.

You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.

NUMBER OF PERSONS USING THE PROPERTY: Under no circumstances may more than the maximum number of persons stated on your booking form and our website occupy the property booked. We reserve the right to refuse admittance or terminate your holiday without reimbursement if this condition is not observed. We permit only the lead guest/booker and members of the stated party at the time of booking to occupy the property and/or grounds for insurance restrictions.

GROUP BOOKINGS A maximum of 3 cottages may be booked by the same party. For larger groups all 7 properties must be booked. If a cancellation is necessary, then 4 cottages must be cancelled. No large groups can book a number of 4,5 or 6 cottages. One lead booker to be responsible for all payments.

LIABILITY. Cwm Connell Coastal Cottages, its employees and its representatives, shall not be liable to you or your party for loss or damage to any personal property howsoever arising. You must take all necessary steps to protect and safeguard your personal property.

CARE OF THE PROPERTY You are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in or on the property. You must leave them in the same state of repair, and in the same clean and tidy condition at the end of the rental period as at the beginning. You must not use the properties for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties. Smoking is not allowed in any of the cottages. Fireworks, chinese lanterns, dye (including hair dye) and felt pens must not be used in the cottage during your stay with us.

SECURITY DEPOSIT Included in the balance payment is a refundable security deposit of £100. You are legally bound to reimburse us for replacement, repair or extra cleaning costs on demand.  Your security deposit will be refunded to the card with which you made payment within 7 days of departure, as long as no damages have occurred. If you lose a key we will replace it upon you paying for a new key.

PETS No pets other than dogs are permitted. We do not accept puppies under six months unless they are crated. Dogs are not permitted in the bedrooms and you must protect soft furnishings with throws. Dogs must be fully house trained and kept on a lead at all times when outside the cottage and within the shared grounds of the property. Your dog must not be allowed to foul the gardens, interfere with neighbouring farm stock or the enjoyment of the holiday of other visitors. Your dog must not be left unattended within the cottage for longer than 2 hours. If left your dog must be contained within a hallway/porch and not left to roam the cottage. You must advise us the owners if you are leaving your dog unattended.

RIGHT OF ENTRY We shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

COMPLAINTS Every effort has been made to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, it is essential that you advise us immediately to give us the chance to resolve it. We value your custom and would like you to return.

LAW Any disputes you may have with us are dealt with by the Courts of England & Wales only.

HOT TUB & SAUNA – TERMS & CONDITIONS

We monitor the disinfectant and PH levels in the hot tub daily. If we need to empty/service or repair the hot tub because of misuse then we will charge £100 to the credit card details taken when the cottage was booked. Whilst we do our utmost to ensure the hot tub is not out of service during your stay, there may be times when it is necessary to empty and clean. This takes 24 hrs during which time the hot tub will not be accessible. No compensations will be paid if the hot tub is out of service.

The Hot Tub will need to be refilled if any of the following are introduced; Urine. Fecal Matter. Glass. Beach Sand. Mud. Stones. Sticks & Cigarette Butts.

You must book in advance using the folder provided in the Laundry Room

Children under the age of 4 are not permitted to use the hot tub. All children must be accompanied/ supervised by an adult of +18 years. Children cannot spend more than 20 mins at a time in the tub. Toys, goggles, snorkels or inflatables are not to be used in the hot tub. Children must not be left unattended near the hot tub. Sandy swimwear previously used at the beach must not be worn in the hot tub. Please shower to remove, oils, sun cream and fake tan before using the hot tub. Please wear shoes when crossing the grounds to the spa area. Strictly no drinking, eating or smoking in the hot tub. Do not use soap or bubble bath in the hot tub. Do not sit, stand or lie on the lid of the hot tub. Do not adjust the settings or tamper with the mechanics.

HOT TUB / SAUNA HEALTH & SAFETY GUIDELINES

During pregnancy soaking in the Hot Tub/Sauna may cause damage to your baby so contact your doctor for advice before entering the water.

Persons with heart disease, diabetes, low or high blood pressure, or any serious illness should not enter the Hot Tub/Sauna without prior consultation with their doctor.

People with skin, ear, genital or other body infections, open sores, or wounds should not use the Hot Tub/Sauna because of the possibility of spreading infection.

Do Not submerge your head in the hot tub for safety & health reasons.

The heat of the water speeds up the effects of alcohol and can cause sleepiness, dizziness and unconsciousness. Do not use the Hot Tub after drinking alcohol. Avoid entering the water immediately after exercising as the water temperature can affect the heart rate.

Never use the Hot Tub while using or after using narcotics or other drugs.

Limit your time in the Hot Tub to a maximum of 20 minutes as extending this time can affect your inner organs and cause fever like conditions. Never use the Hot Tub alone.
 Avoid using the Hot Tub immediately after a heavy meal.

Take care when entering and leaving the Hot Tub. Leg muscles may be relaxed enough to make you unsteady. Steps by the Hot Tub can be slippery when wet.
